This event should inform IP practitioners of the impact the Jackson
Report anticipated by the judiciary, industry and the profession.
We anticipate that there will be an opportunity to ask questions
after the talk.
Losing one's family to influenza has thankfully become rarer than
it was in 1892, but in other respects many still think Lord Esher's
views in Ungar v Sugg (1892) 9 RPC 113 broadly reflect the reality.
The reforms suggested in the Jackson Report, at least for larger
cases, are incremental rather than revolutionary: notably, a call
for even more robust case management. Smaller cases, through changes
in the Patents County Court, face deeper procedural change. Our
speakers will provide insight for IP litigators into the impact
of the Jackson Report from three distinct perspectives, and whether
the changes will rescue patentees from the mischief lamented by
Lord Esher.
